Changes to the bankruptcy law, as a result of the Bankruptcy Abuse and Consumer Protection Act of 2005, became effective on October 17, 2005.

Most individuals who file for bankruptcy after October 17, 2005 must undergo 2 mandatory requirements:

  1. Pre-Bankruptcy Counseling
  2. Debtor Education Course

Approved Provider of Pre-Bankruptcy Counseling

CIDMCE has been approved to issue certificates evidencing completion of counseling in compliance with the Bankruptcy Code. Approval does not endorse or assure the quality of a Provider's services. Under the new act, individual debtors who file bankruptcy on or after October 17, 2005, must undergo credit counseling within 6 months before they file bankruptcy.

As an approved credit-counseling agency, CIDMCE will provide pre-filing credit counseling to consumers in need of fulfilling the requirements under the new act. A thorough assessment of your financial situation including establishing a budget analysis and the options available to help you will be provided. A certificate will be provided upon completion of the counseling session, which will enable you to proceed with the bankruptcy process. Counseling is available by phone or in person. Approved Provider of Debtor Education

CIDMCE has been approved to issue certificates evidencing completion of personal financial management instructional course in compliance with the Bankruptcy Code. Approval does not endorse or assure the quality of a Provider's services. Under the new act, individual debtors who file bankruptcy on or after October 17, 2005, must successfully complete a financial management instructional course prior to discharge of debt when filing bankruptcy.

CIDMCE has designed a debtor education course that will fulfill the financial education requirement under the new act. The course is available in person or by internet. You will receive course information and material needed in order to comply with the new requirement. Upon successful completion of the course, you will be able to proceed with the bankruptcy process.
